(LOUISVILLE, KY.) 01/03/2017–#KSPpost4 Troopers arrested a Louisville man after a pursuit on the Greenbelt Highway in Jefferson County. On Sunday, January 1, 2017 at approximately 9:22 P.M. EDST, Trooper Ken Borders observed a Dodge pickup truck speeding 72 mph in a 55 mph zone and activated his emergency equipment to stop the vehicle.
At this time, police say that the suspect, James F. McClelland, 29, of Louisville, refused to stop and accelerated before turning onto multiple side streets and re-entering the Greenbelt and accelerating again.

The suspect then turned onto Lewis Way where he drove into a muddy field and became stuck.

During the pursuit, the suspect came to a stop at Lower River Rd. and Moorman Rd. Trooper Borders heard a shot come from the suspect vehicle and then witnessed the suspect’s vehicle quickly accelerate again away from the scene. The suspect then turned onto Lewis Way where he drove into a muddy field and became stuck. After a brief foot pursuit, Tpr. Borders was able to catch up to the suspect and deploy his Taser striking the suspect. After a brief scuffle, Mr. McClelland was placed under arrest without further incident.

McClelland was charged with the following: Speeding, Wanton Endangerment 1st (Police Officer), Wanton Endangerment 1st, Tampering With Physical Evidence, Fleeing or Evading Police 1st (Motor Vehicle), Fleeing Or Evading Police 1st (On Foot), Operating A Motor Vehicle Under The Influence (Aggravating Circumstance), Assault 3rd, Criminal Mischief 3rd, Violation of An EPO/DVO, Reckless Driving, No Registration Plates, No Registration Receipt, Failure Of Owner To Maintain Required Insurance, Failure To Or Improper Signal, Improper Passing, and Possession of A Handgun by a Convicted Felon. He was subsequently lodged at Louisville Metro Corrections. The incident is still under investigation by KSP Post 4.

Upon further investigation, Evans was placed under arrest for Operating a Motor Vehicle under the influence, Possession of Controlled Substance 1st degree, 1st offense (Methamphetamine), Possession of Drug Paraphernalia and Open Alcohol Beverage Container in Motor Vehicle Prohibited. Charles S. Evans was transported and lodged at Henderson County Detention Center.

California: CHP reports fatal crash in Humboldt County DUI related

FATAL TRAFFIC COLLISION ON MOUNTAIN VIEW ROAD

Humboldt County, California – On Sunday, January 1, 2017, a 1995 GMC Sierra was traveling on Mountain View Road, when it left the roadway causing the vehicle to roll.

At approximately 5:30 p.m., a 1995 GMC Sierra, driven by, a 52-year-old man, of Eureka, traveled off of the roadway and rolled down the embankment. As a result of this collision, the driver of the GMC was partially ejected and sustained fatal injuries. A passenger in the GMC sustained minor injuries and was able to walk several miles to call for emergency assistance. Alcohol is suspected to be a factor in this collision. The California Highway Patrol Humboldt Area is the lead investigating agency in this traffic collision.

Lexington, S.C. (January 6, 2017) – The Lexington Police Department continues to investigate an overnight D.U.I. related traffic fatality collision which resulted in the death of a driver in one of the two vehicles involved.
Police say that on Thursday, January 5, 2017, at approximately 11:12 p.m., officers of the Lexington Police Department responded to a collision with injuries that occurred near the 4200 block of Sunset Blvd. in Lexington, South Carolina.

The driver of one of the vehicles involved died from injuries sustained during the collision.

During the course of the investigation, it was found that the driver who caused the collision by failing to stop for a signal light was intoxicated.

This driver was identified as Nicole Marie Wilson of Lexington, South Carolina.

Nicole Marie Wilson was transported to the Lexington County Detention Center and charged with Felony Driving Under the Influence Involving Death.
Lexington County Coroner Margaret Fisher has identified the victim as 75-year-old Roger Johnson of Cayce. Johnson was taken to the hospital where he died from blunt force trauma.

BOWIE, MD. — As St. Mary’s County Sheriff Tim Cameron wrestles with how to handle the recent DUI crash and arrest which involved one of his deputies and a correctional officer while on a mission in Talbot County to learn how to carry caskets for official funerals; Charles County Sheriff Troy Berry has to worry about an important criminal case being affected by the DUI arrest of one of his detectives in Prince George’s County.

After a reported Christmas Eve stopover at a bar in Bowie, Charles County Detective Young Jack Austin, 43, of Pomfret, Md., was arrested for DUI by a City of Bowie Police Officer while he drove an official police vehicle, a 2008 Chevrolet with Maryland tag number 14364M5 on Hindle Lane, in Bowie, Md.

The driver was located and appeared to be under the influence of alcohol. It was also learned at this time that the driver was an off-duty Charles County Sheriff Deputy and the vehicle was his issued unmarked cruiser.

The following is the report from the Bowie Police:

SYNOPSIS OF INCIDENT:
On 12/23/16, Units responded to the area of Hindle Lane for an unknown trouble. Once in the area, Units discovered a vehicle on the bike path from Holiday Lane at Old Collington Rd. It was then determined to be an accident. The driver was located and appeared to be under the influence of alcohol. It was also learned at this time that the driver was an off-duty Charles County Sheriff Deputy and the vehicle was his issued unmarked cruiser. Sgt. Rodriguez made notifications to C.C.S.D. and Sgt. Celia responded to the Bowie Police Station. After failing Field Sobriety Tests, the driver was transported to PGPD District 2 where he refused a breath test. He was then transported to the Bowie Police Station and charged. His duty weapon was surrendered to Sgt. Celia. The accident was a single vehicle accident with no injuries.

Charles County Sheriff’s Spokesperson Diane Richardson confirmed to THE CHESAPEAKE TODAY that Detective Austin is on paid leave pending the outcome of the charges and internal investigation.

Court records do not recite any pending court date in District Court for Prince George’s County perhaps due to the involvement of Detective Austin in a high-profile criminal trial currently underway.

It is unknown if Detective Austin was part of the ‘Shop with a Cop’ program on Christmas Eve or if he was simply getting a few holiday drinks with a cop in Bowie. The Bowie Police Department provided a video of their Chief participating in the ‘Shop with a Cop’

Detective Austin was honored by Charles County Sheriff Troy Berry in October of 2016, at an awards ceremony.

The victim was eventually able to convince her attacker to let her use the bathroom. Only then was she able to escape through a window. The investigation was assigned to Detective Austin, who worked tirelessly on the case to ensure the suspect was prosecuted to the fullest extent. At his trial, the suspect was found guilty and was sentenced to life in prison plus 30 years.

Since the attack, Det. Austin has maintained contact with the victim and has been a valuable resource to her, even during his off-duty time. The victim credits Detective Austin, among others, with helping her turn her life around and move in a positive direction.  For his exceptional work on this and every domestic case he investigates, Detective Austin was awarded the Making a Difference Award in the Law Enforcement category.

TORTURED WOMAN FOR HOURS Stephen Dale Nolan, 38, of La Plata, convicted of rape and attempted murder in La Plata

On May 10, 2014, Charles County sheriff’s officers assigned to the Warrant Unit located Stephen Dale Nolan, 38, of La Plata, who was wanted in connection with a brutal assault of a female acquaintance that occurred on May 8, 2014. Nolan was located in Hughesville after investigators developed information about his possible whereabouts and tracked down all leads until he was found. Nolan was charged with first-degree assault, second-degree assault, first-degree sex offense, second-degree sex offense and other charges.

Detective Young Jack Austin has been a lead investigator on these recent major crimes

POLICE AGENCIES WRESTLE WITH DUI OFFICER PROBLEM

Many law enforcement agencies generally have at least one such DUI arrest of an officer in any given year, some of which involve fatal crashes.  Police officers have as much, or perhaps much more stress on the job than many other professions which often leads to alcoholism. While there are those officers in law enforcement who clearly exhibit arrogance, and decide to drive after drinking, many make the same mistake as others do in life and simply make a bad decision. While the public supports the police in overwhelming numbers, the public also supports sobriety checkpoints in overwhelming numbers as most folks simply want to get home alive and not be killed by a DUI driver.

The nationwide DWI HIT PARADE has chronicled the arrests of 290 police officers for driving under the influence since 2011. Other occupations are listed as well, including politicians, celebrities, judges and lawyers, clergy and news reporters and editors.

A 2013 study by Bowling Green State University on what happens when a police officer is arrested for DUI while on duty provides one of the few glimpses that have been chronicled on the topic.

This segment of the study focused on news coverage of the DUI Police Officer scandals, stories that were over the top in nature, due mostly to the explosive nature of the events rather than a simple arrest on the side of the road.

Scandals involving law enforcement officers who drive drunk run counter to the widely-recognized slogans of police-sponsored public service campaigns to promote sober driving: “Drive sober or get pulled over, “…”Over the limit, under arrest, “…”Drink, drive, go to jail” (Governors Highway Safety Association 2012, National Highway Traffic Safety Administration 2012, Texas Department of Transportation 2012). One scandal involved an intoxicated officer who joined a high-speed pursuit and rammed his patrol car into three motorcyclists stopped at a red light. Charges including reckless homicide were eventually dropped in part because of a botched investigation that also ultimately led to the police chief’s resignation (Indianapolis Star 2012). Another case involved a drunken police commander who crashed into a second vehicle, left the scene, and then helped to stage a phony accident to cover-up the initial crash. Blood-alcohol tests were not conducted at the scene, even though the commander’s speech was slurred, he smelled of alcohol, and he had wet his pants (Fazlollah 2001, Banks 2013). Another scandal involved a police lieutenant arrested—but not convicted—for driving under the influence three separate times over a seven-month period. He was finally convicted on a DUI charge that resulted from a fourth arrest that occurred three months later (Castaneda 2008, Davis 2008).

The problem of police officers driving drunk may be far more under-reported since on-duty officers may or may not arrest another police officer for driving under the influence. In the cases of those police officers arrested for DUI, the arrest would not have taken place were it not that the arresting officer was doing his or her job properly.

Police DUI’s have the potential to substantially weaken public trust and the legitimacy of strategies designed to mitigate drunk driving because the drunk driver in these cases is among those expected to enforce DUI laws and protect society from drivers who are intoxicated. Recent evidence suggests that the problem may be exacerbated by officers and agencies that minimize—and in some cases purposively ignore—the problem of drunk driving among police.

A Bureau of Justice Statistics survey reported that over one-third of responding state and local police agencies would consider police applicants with a prior DUI conviction (Reaves 2012). Likewise, a majority of officers responding to a survey on police integrity said they would not report a fellow officer who had a minor traffic accident while driving under the influence of alcohol (Klockars et al. 2000). Recent journalistic investigations in Milwaukee (Barton 2011), Denver (McGhee 2011), and New York City (Paddock and Lesser 2010) reported disturbing cases in which police found to have driven drunk were either not arrested and/or otherwise minimally punished. The tendency of officers and at least some police executives to disregard police DUI’s limits the potential for research and the availability of data on the problem, and also inhibits the development of strategies to identify, punish, and deter drunk driving among police officers.

Seminole County, Florida – (March 27, 2017) – The Seminole County Sheriff reports that on March 26, 2017, at approximately 9:12 p.m., Seminole County Sheriff’s deputies responded to a traffic crash near the 4000 block of Creekview Circle, in unincorporated Oviedo.

Upon arrival, deputies located the driver, Alexander Chapman, at a nearby residence. Chapman stated he was out for a drive with his 6-month-old baby in his vehicle when he misjudged a turn and crashed into a tree.

Deputies observed Chapman’s eyes appeared droopy and his speech slurred.

Deputies observed Chapman’s eyes appeared droopy and his speech slurred. A series of field sobriety tests were conducted, and based on Chapman’s performance, he was arrested. Chapman was booked into the John E. Polk Correctional Facility on charges of Child Neglect, Driving Under the Influence, and Leaving the Scene of a Crash. He remains incarcerated on a $6,000 bond. No injuries were reported as a result of the accident.

REPORT FROM ARRESTING DEPUTY ON STATEMENT OF CHARGES:
On March 26, 2017, at approximately 2112 hours, I responded to a vehicle crash located at 4661 Creekview Lane. The crash was reported as a vehicle versus a tree. Upon arrival, I observed gold Hyundai bearing the tag: GGEJ53 that had been crashed into a tree. I then conducted the crash investigation and located the driver of the vehicle, which was located at 2537 Creekview Circle, which is not his residence. The driver, Alexander Lewis Chapman (D.O.B 10-08-1988), identified by his Florida Driver’s License, stated he was taking out for a ride. Alexander advised his mirror was hanging from his front windshield and caused him to misjudge the turn causing him to hit the tree. After the crash investigation was complete, I informed Alexander the investigation for the crash was complete and notified him that I am now starting an investigation for DUI. I then asked Alexander, the driver of the gold Hyundai, to walk over to the front of my patrol vehicle and he complied. Once at my patrol vehicle Alexander was read his Miranda warnings off my department issued card. Alexander stated that he understood each of his rights and willingly agreed to talk to me. During conversation with Alexander, I observed that he had slurred speech, and droopy eyes.

I then asked if Alexander, if he was willing to perform field sobriety exercises. Alexander stated that he was willing to. Each exercise was both demonstrated and explained before the defendant was asked to perform the exercise. Alexander verbally replied that he understood each exercise before he started. Before the exercises started, I asked Alexander, do you have any physical limitations that would hinder your performance on the field sobriety exercises? He stated that he has glasses but that he was currently wearing contacts. He also advised that he would do the exercises barefoot, due to it being more comfortable. I asked the defendant, do you have any problems with your arms, legs, or balance? The defendant stated, No. The field sobriety exercises were done on a flat and level surface, free from debris, and my emergency lights and siren turned off. The first exercise was the (HGN) Horizontal Gaze Nystagmus. During the exercise I observed the following: (No glasses) Pupils were equal in size Checked for equal tracking, both eyes tracked equally -Lack of smooth pursuit in both the Left and Right eyes -Onset Nystagmus prior to 45 degrees in both eyes -Checked Vertical Gaze Nystagmus -Eyes were glassy, watery. -Swayed while standing still -Unable to follow instructions: did not maintain contact with tip of pen. The second exercise was the (WAT) Walk and Turn. During the exercise I observed the following: -failed to count steps -Failed to stay on line while walking -failed to look down while he walked -stopped during exercise to verify if he was doing it correct -Can`t keep balance -Missed several heel to toe steps -Stepped off the line -Used arms to balance, raised arms over six inches The third exercise was the (OLS) One Leg Stand. (Used his right leg for the exercise) During the exercise I observed the following: -Swayed while balancing -Used arms to balance, raised arms more than six inches -Unable to follow instructions. Dropped foot multiple times -Even after the defendant put he foot down, I informed he to do the above listed instructions and he still failed to perform the divided attention tasks -Placed arms behind back -counted (16) twice The fourth exercise was the Finger to Nose (FTN). (R,L,L,R,L) During the exercise I observed the following: -Failed to return arms to the side (on the first attempt) -movements were very slow -Failed to return arms to the side -Tip of Index finger did not touch tip of the nose on ALL attempts -Touched the left side of nose with right hand The fifth exercise was the Rhomberg Alphabet: (B through X) During the exercise I observed the following: -orbital sway -Skipped letters between R-X.

After the exercises were completed, I determined the defendant`s normal faculties required to operate a motor vehicle were impaired beyond the legal limit by either alcohol and or drugs. Therefore, the defendant was arrested for Driving Under the Influence of Alcohol and or Drugs, F.S.S. 316.193. Due to Alexander not having in a proper child restraint and facing the correct way, he did not provide with the care, supervision, and services necessary to maintain the child’s physical and mental health. Alexander also was seen leaving in the car at the scene of the traffic accident.
Due to the facts and circumstances, Alexander is in violation of F.S.S 827.03 (2d) – Neglect child without great bodily harm.
Alexander was seen by an off-duty fireman, leaving the scene that had more than $50 damage, due to the airbag deployment and the front end damage, which is in violation of 316.061 (1)- Hit and run- leave the scene of a crash involving damage to property greater than $50. Alexander was placed in handcuffs that were checked for proper fit and double locked.
The defendant was transported to the John E. Polk Correctional Facility Upon arrival at the jail, the defendant was turned over to the Breath Technician, Ray Garcia.
The defendant was asked to provide a lawful sample of his breath and urine and he refused. Mr. Garcia read the defendant Implied Consent, the defendant acknowledged the consequences, and still refused to provide a breath sample and urine sample.
Due to him being in a car accident he needed to medically cleared. Alexander was taken to Central Florida Hospital, cleared, and returned to the John E. Polk Correctional Facility.

The New York State Police at Fillmore reports the arrest of Justin C. Spencer for DWI

On April 15, 2017, Troopers arrested Justin C. Spencer, 31, of Portageville, NY, for Driving While Intoxicated.

Troopers investigating a 2-car accident on State Route 70 in the Town of Grove arrested Justin C. Spencer for Aggravated Driving While Intoxicated.  Spencer had struck a guard rail and then rear-ended another vehicle.

While Troopers interviewed Spencer, the odor of an alcoholic beverage was detected.  SFSTs were attempted but stopped for safety reasons.  Spencer was arrested and transported to SP Fillmore where he recorded a 0.19% BAC.  He was released on tickets and is due in the Town of Grove Court on 6/5/17 at 1:00 PM.

On April 19, 2017, at approximately 9:24 pm, Troopers arrested Dennis P. Strader 44 of Delevan NY for driving while intoxicated and failing to signal a turn.

Strader was stopped on State Route 16 in the Town of Machias for failing to signal a turn at the traffic light.  During the interview, the odor of alcoholic beverage was present.  Strader was given SFST’s to which he failed.  Strader was transported to Sp Machias for processing, where he recorded a .10%BAC.

 

On April 10, 2017, Troopers arrested Donald W. Schultz, 46, of Belmont, NY, for Driving While Intoxicated.

Troopers stopped a truck with no tail lamps or license plates on County Route 2 in the Town of Almond.  While interviewing driver Donald W. Schultz, the odor of an alcoholic beverage was detected.  Schultz would not perform any SFSTs.  He was arrested and transported to SP Amity where he refused to provide a breath sample.  He was arraigned before the Town of Almond Court and released to reappear on 4/17/17 at 5:00 PM.

On March 29, 2017, at approximately 8 p.m. State Police responded to a County Route 55 in the town of Brasher for a one-car roll-over crash.

An investigation at the scene revealed that a witness in a nearby residence had called 911 after hearing a loud crash and watching the male operator flee on foot into the woods. Troopers utilized K-9 to locate the operator, who was found approximately 1/2 mile southwest of the scene.  Ervin E. Francis IV, 27, of Malone, was subsequently arrested for DWI. He was not injured. His blood alcohol content was determined to be 0.18%.

Francis was charged with Aggravated DWI, and further ticketed for leaving the scene of a property damage accident, aggravated unlicensed operation 3rd degree, open container of alcohol in a motor vehicle, speed not reasonable and prudent, and failure to use designated lane.  He was arraigned in the Town of Brasher Court where he was remanded to the St. Lawrence County Jail in lieu of $2,000 cash bail or $4,000 bond. He is to reappear in the Town of Brasher Court on April 18, 2017, at 6 p.m.

On March 30, 2017, at approximately 1 a.m., State Police arrested 26-year-old Krystina C. Stillwell of Potsdam for DWI following a traffic stop on Miner Street in the village of Canton for operating with no headlights.

Stillwell’s blood alcohol content was determined to be .15%. She was also found with an open can of alcohol inside the vehicle. Stillwell was charged with DWI, and further ticketed for operating without headlights, and open container of alcohol in a motor vehicle. She was released with tickets returnable to the Town of Canton Court on April 26, 2017, at 1:30 p.m.

Brandon R. Elia, age 22, of Spencer, NY Driving While Ability Impaired by Drug NYSP

(Spencer, NY – April 20, 2017) On April 17, 2017, at about 11:33 p.m., New York State Police at Owego arrested Brandon R. Elia, age 22, of Spencer, NY for the misdemeanor of Driving While Ability Impaired by Drugs and other traffic violations.

This arrest occurred after a traffic stop when a vehicle with a loud exhaust was seen driving on State Route 96, near East Spencer Road, in the Town of Spencer.  An investigation determined that Elia was driving while his ability was impaired by drugs.  He consented to a test of his urine for drugs but the lab results are pending.

Elia was issued tickets returnable to the Town of Spencer Court on May 10, 2017, and was released.

 

WRONG-WAY BOZO ON INTERSTATE CHARGED WITH DWI

New York State Police say that on 04/14/17, at approximately 2:30 AM, the State Police received a cellular 911 call for a pickup truck traveling in the wrong direction on I-590 at Empire Boulevard in the town of Irondequoit.? Troopers located the vehicle traveling southbound in the northbound lanes of I-390 in the town of Brighton.

The operator, Michael Flaville, a 39-year-old male from Millville, New Jersey, was arrested for Driving While Intoxicated.? Flaville provided a breath sample indicating a .15% BAC. He was issued Uniform Traffic Tickets for Driving While Intoxicated, Driving with a BAC >.08%, driving the wrong way on a one-way street, Reckless Driving, and improper entrance to a limited access highway, as well as Reckless Endangerment 2nd.? Flaville was remanded to the Monroe County jail for morning arraignment.

Kori E. Lane charged with DUI fatal crash

On May 20th, just after midnight, Deputy Josh Anderson was dispatched to Griggstown Road at Salyer Creek Road in reference to an injury, single vehicle, crash. According to a citation filed by Deputy Anderson the vehicle had been driven by Kori E. Lane age 18 of Paducah. The investigation by Deputy Anderson revealed that Lane was operating the vehicle in a reckless manner and at high speed. The investigation further revealed that Lane had been drinking. The passenger in the vehicle, Sierra Jones age 16 was pronounced dead at the scene. Kori E. Lane was charged with Operating a Motor Vehicle U/Influence ALC/Drugs/Etc .08 – 1st Offense and Murder. Deputy Anderson was assisted in the investigation by Detective Nathan Maxlow, Sergeant Jason Lane, and Officer Ryan Moore of the Benton Police Department. There were many agencies that responded to assist with this tragic crash. Some of these include the Marshall County Sheriff’s Office, Benton Police Department, Marshall County Coroner’s Office, Marshall County EMS, and Palma Briensburg Fire Department.

On May 29th at approximately 8:21 pm, Sergeant Tim Reynolds arrested Justin Isaiah Wilson age 26 of Paducah for Operating a Motor Vehicle U/Influence ALC/Drugs/Etc ( Aggravating Circumstances ) 2nd Offense. Wilson was intoxicated in his vehicle in the parking lot at a business in Draffenville. SGT. Reynolds was assisted by Deputy Chris Greenfield.

On May 29th, Deputy Chris Greenfield was dispatched to US 68 West in reference to a possible DUI driver. He located the vehicle and conducted a traffic stop. Deputy Greenfield’s investigation resulted in the arrest of Corey Lee Herndon age 38 of Paducah on charges of Operating a Motor Vehicle U/ Influence ALC/Drugs/etc .08 1st Offense and Wanton Endangerment 1st Degree. A small child was in the vehicle.

On May 28th, at approximately 11:56 pm, Deputy Chris Greenfield was dispatched to Little Bear Highway in reference to a possible DUI driver. Deputy Greenfield found the vehicle just after it was parked at a residence on Little Bear Highway. The investigation resulted in the arrest of Wendy Baker on the following charges:
Operating a Motor Vehicle U/Influence ALC/Drugs/Etc .08 ( Aggravating Circumstances 2nd Offense and No Operators License.

 

 

On the evening of May 23rd, Sheriff Kevin Byars investigated an injury crash on Jackson School Road. When Sheriff Byars arrived, it was reported that the driver of one of the vehicles had fled the scene. Marshall County Sheriff’s Deputies and Benton Police Officers responded to the scene and began to search for the suspect. A short time later, Major David Maddox located the suspect in a field. Ronald T. Fleet age 42 of Benton was taken into custody without incident. Fleet was charged with DUI 3rd Offense, Operating on Suspended Operators License, and Leaving the Scene of an Accident. After being transported to Marshall County Hospital for the treatment of minor injuries received in the crash, Fleet was transported and lodged in the Marshall County Detention Center.

On May 22 at approximately 9:50 pm, Deputy Chris Greenfield was on Rudd Lane answering a Harassment complaint. He was speaking to two complainants, Aaron Matthews and his girlfriend outside of their home. Aaron was obviously intoxicated and continued to yell obscenities and interrupt while his girlfriend made the report. He was yelling for Deputy Greenfield to ” order drugs ” and yelling obscenities. Deputy Greenfield placed Matthews under arrest for Alcohol Intoxication and Disorderly Conduct 2nd Degree. He was lodged in the Marshall County Detention Center.

On May 18th at approximately 3:15 pm, Deputy Dennis Lewis served an indictment warrant and arrest warrant on Dustin R. Frazier age 24 of Hopkinsville. The arrest warrant was for failure to appear in Christian County Circuit Court. The Marshall County Indictment warrant charged Frazier with Operating a Motor Vehicle U/ Influence ALC/Drugs/Etc .08 – 1st Offense, Possession of Controlled Substance 1st Degree 1st Offense – Methamphetamine, No Operators License, Drug Paraphernalia – Buy / Poss, Failure of Non-Owner Operator To Maintain Required Insurance and Wanton Endangerment 1st Degree.

On May 13th, Deputy Josh Anderson was dispatched to Purchase Parkway in reference to a single vehicle crash. After the investigation, Deputy Anderson arrested the driver, Corey W. Clark age 18 of Calvert City was charged with Operating A Motor Vehicle U/ Influence ALC/Drugs/Etc .08 1st Offense.

On May 14th, Sergeant Jason Lane received a call from dispatch in reference to a motorist calling about a reckless driver striking barrels at the construction area at the 41mm of Purchase Parkway. SGT. Lane and Deputy Josh Anderson found the vehicle stuck in the median at the 40mm. As a result of the ensuing investigation, Seth J. Reddick age 25 of Bardwell was arrested and charged with Operating a Motor Vehicle U/ Influence ALC/Drugs/Etc .08 ( Aggravating Circumstances ) 1st Offense.

On May 14th, Deputy William Strader and Deputy Cory Curtner were dispatched to a store in Draffenville as there was a possibly intoxicated person who was shoplifting. As the matter progressed, Officer Caleb Curtner of the Benton Police Department and SGT. Tim Reynolds from the Sheriff’s Office also responded to assist. When officers arrived, the suspect was locked in the bathroom from where the officers recovered several empty bags of food that had been eaten but not paid for. Deputies observed that he appeared manifestly under the influence and they also found a warrant for his arrest. Matthew C. Moss age 26 of Benton was charged with Theft by Unlawful Taking – Shop Lifting, Public Intoxication – Controlled Substance, Resisting Arrest, Menacing, Terroristic Threatening, and Criminal Mischief 1st Degree. During the arrest, one of the deputies vehicles was damaged by the suspect kicking.

On May 14th at approximately 10:35 pm, Sergeant Tim Reynolds responded to a store in Hardin in reference to a report of an intoxicated person. SGT. Reynolds stopped the vehicle nearby and as a result of the investigation, Robert B. Phillips, age 30 of Benton was arrested and charged with the following:

The driver indicated smoking marijuana, taking Xanax, and methadone. Small baggies of marijuana that appeared to be prepped for sale were found.

On May 7th at approximately 11:00 pm, Deputy Chris Greenfield conducted a traffic stop at US 68 and George Clark Road on a vehicle with expired tags. A passenger in the vehicle was found to be the owner and was given a warning for expired tags. The continuing investigation resulted in the arrest of the driver, Gary Wayne Stamper age 36 of Benton for Operating a Motor Vehicle U/Influence ALC/Drugs/Etc .08 Aggravating Circumstances 1st Offense and Drug Paraphernalia – Buy / Possess. Deputy Greenfield seized used syringes and other items from the vehicle.

On May 7th, Deputy Josh Anderson was dispatched to a single vehicle crash on KY 95. As a result of the investigation the driver, Melissa E. Kornegay age 28 of Benton, was arrested and charged with Operating a Motor Vehicle U/Influence ALC/Drugs/Etc .08 Aggravating Circumstances 1st Offense.

On May 3rd at 10:52 pm, Deputy Dennis Lewis was dispatched to the ramp from Purchase Parkway to US 641 in reference to a single vehicle crash. According to the citation filed by Deputy Lewis, Upon arrival, he could smell the odor of an alcoholic beverage on the driver. Upon investigation, the driver Rachel L Clark age 36 of Kuttawa was arrested and charged with Operating a Motor Vehicle Under the Influence ALC/Drugs/Etc .08 1st Offense. Deputy Lewis lodged Clark in the Marshall County Detention Center. A short time later Marshall County Detention contacted Sergeant Tim Reynolds and reported that they had found a controlled substance in the clothing of Clark. According to a citation filed by SGT. Reynolds, Deputy Jailer Sara Wood found two Hydrocodone pills in the underwear of Clark. SGT. Reynolds charged Clark with Promoting Contraband 1st Degree and Possession of Controlled Substance 3rd Degree. Clark remained lodged in the Marshall County Detention Center.

On May 2 at 2:27 pm, SGT. Eddie McGuire was dispatched to Draffenville in reference to a single vehicle crash. Upon arrival, SGT. McGuire observed that the driver appeared intoxicated. The investigation revealed that the driver had taken Lortab. Thomas E. Wooten age 64 of Benton was arrested and charged with Operating a Motor Vehicle Under the Influence of ALC/Drugs/Etc 1st Offense Agg. He was lodged in the Marshall County Detention Center.

Second Arrest Made in Muncie Fatal Crash Investigation

Muncie, Indiana – Indiana State Police report that a second arrest was made on May 30, 2017, as the result of the ongoing investigation into a fatal crash that claimed the life of a 6-year-old girl Sunday afternoon. Sunday around 4:30 p.m. officers responded to a report of an overturned vehicle on the north bound SR 67, the Muncie Bypass, just north of Meeker Avenue. Troopers Coley McCutcheon and Eric Patterson along with Delaware County Deputies arrived to find a car rolled over on the right side of the road.

The preliminary investigation indicated the driver, Jessica Skeens age 28 of Farmland, was driving a van north on the Muncie Bypass with her boyfriend, Nathaniel Jordan, age 27 of Muncie, with two of her children in the middle seat in child restraint seats, and two more of her children in the rear seat without child restraint seats.

Skeens and Jordan had been arguing when Jordan punched Skeens and grabbed the steering wheel, causing her to lose control of the van.

Skeens 6-year-old daughter, Taelyn Woodson, a back seat passenger who was not properly restrained in a child restraint seat, was partially ejected out of a window and succumbed to her injuries. The other three children in the van were transported to I.U. Health’s Ball Memorial Hospital for the treatment of minor injuries. Crash Reconstruction Investigator Trooper Scott Keegan was summoned to the scene to assist with the investigation.

After the prosecutor’s office preliminary review of the ongoing investigation, Jessica Skeens, age 28, was arrested May 30, 2017, and charged with Neglect of a Dependent Causing Death, Level 1 Felony; Operating While Intoxicated Causing the Death of another person, a Level 5 Felony; Operating While Intoxicated with a passenger less than 18 yrs. of age, Level 5 Felony and three counts of Neglect of a Dependent, Level 5 Felony.

Toxicology reports showed that Skeens had a B.A.C. over the .08% legal limit at the time of the crash. Skeens was lodged in the Delaware County Jail.This is all the information available for release at this time.

HANFORD, CALIF. — 06/08/2017 — California High Patrol officers believe alcohol may have been a factor in a fatal crash late Tuesday night on Highway 43 near Conejo Avenue.

At 10:34 p.m., the Fresno Communication Center received a call of a traffic collision on Highway 43 just north of Conejo Avenue with officers responding to investigate.

According to the CHP, the investigation determined that 26-year-old Hector Torres of Riverdale had been stopped on the east shoulder of Highway 43 when he pulled across the northbound lane, possibly attempting a U-turn.

The CHP was later notified that the 79-year-old man died while at Adventist Medical Center. His name had not been released pending the notification of family.

According to officers, Torres is suspected to have been under influence of alcohol. CHP officers are unsure if the death was the result of the collision or a pre-existing medical condition.   MORE

06/08/2017 — The Fresno District Attorney reports that Rien Ban was sentenced to sixty (60) years to life in prison on Jan. 12, 2017, for a 2014 DUI collision that killed four people. The prosecution was led by Senior Deputy District Attorney Billy Terrence and Senior Investigator Jesse Perez. On June 22, 2014, Mr. Ban caused a collision on Highway 180 between Kerman and Mendota killing Lisandro Rodriguez (10), Danny Rodriguez (7), Belkys Quezada (25), and Sinoeun Uong (37). Mr. Ban’s blood alcohol level was measured at 0.21% two hours after the collision.

Ban had twice been convicted of driving under the influence 2000 and 2006.

In each of those cases, Mr. Ban was warned that if he continued to drive under the influence of alcohol, and as a result, somebody was killed, he could be charged with murder. Because of his history of driving under the influence, the District Attorney’s Office elected to prosecute Ban for murder, as opposed to gross vehicular manslaughter, based on the theory that he acted with a conscious disregard for human life when he chose to drink and drive.

On November 17, 2016, a Fresno County jury deliberated for one hour before finding Ban guilty of four (4) counts of second-degree murder.

SDDA Terrence stated, “The defendant placed his own selfish interest to drink and drive above the safety of other human beings in our community.”

Fresno County Superior Court Judge Conklin sentenced Mr. Ban to the maximum term of sixty (60) years to life at the California State Department of Corrections and Rehabilitation. However, upon reaching age 60 and after serving 25 years, Ban will be eligible for release under the Elderly Parole program. Michael Bortolametti charged with DUI for killing motorcyclist John Simone on Metro Parkway

 

FORT MYERS, FLA. — Late on Thursday evening, June 16, 2017, an alleged DUI driver struck two people who were standing in the turn lane of Metro Parkway, killing one and injuring the other.

Florida Highway Patrol reports that Michael Bortolametti, 22, of Cape Coral, was operating a 1998 Mercedes-Benz C230 south in the left lane of Metro Parkway at around 11:47 p.m., officials said. Bortolametti was approaching Topaz Court when he struck two pedestrians.

John M. Simone, 42, of Cape Coral and Marie R. Taylor, 26, of Fort Myers were in the left lane of the parkway and their motorcycles were parked nearby, officials said, when the Mercedes plowed into them.

Simone was pronounced dead at the scene and Taylor was transported to Lee Memorial Hospital with minor injuries, officials said.

Police say that Bortolametti and his passengers, Taylor Strosnider, 21, of Cape Coral, and Madison Strosnider, 21, also of Cape Coral were uninjured.

Austin Campbell pleaded guilty to DUI manslaughter in the death of Jacob Cecil.

06/20/2017 — According to the Ada County Prosecutor Jan Bennetts, Austin Eugene Campbell has entered a guilty plea to one count of Vehicular Manslaughter, and one count of Aggravated Driving While Under the Influence. Campbell appeared in District Court today before the Honorable Judge Deborah Bail to enter the pleas. These charges stemmed from an incident when Campbell was driving friend’s home from a bar and lost control of his vehicle while trying to exit the connector. One passenger  Jacob Cecil, was killed in the crash. Two other passengers suffered major injuries and a fourth passenger also suffered injuries. Campbell’s blood alcohol level was determined to be .211.

Felony Vehicular Manslaughter is a felony charge which carries a potential penalty of up to fifteen years in prison and/or a $15,000 fine. Aggravated Driving While Under the Influence is also a felony charge and carries a potential penalty of up to fifteen years in prison and/or a $5,000 fine.

Evidence at the scene revealed a crushed beer can, a case of beer and a bottle of whiskey that was three-fourths full were found at the scene, prosecutors said.

Officers reportedly described Campbell as “belligerent,” and he refused to tell them how much he had to drink. A warrant was issued to mandate a blood draw, according to the prosecution.

Campbell accepted a plea agreement whereby the State will recommend a prison sentence of six years fixed, and nine years indeterminate, for a total sentence of fifteen years, on each count. The State will recommend that the two sentences run concurrent. A second count of Aggravated Driving While Under the Influence will be dismissed as part of that agreement. The Defendant is free to argue for a lesser penalty.

Sentencing will be held on Friday, August 25th, 2017, at 9:30am.

Esteban Juarez-Tomas, 33, is wanted for aggravated DUI, resulting in the death of LaDonna Jeannie Brady, of Mahomet, Illinois, on Jan. 1, 2017

CHICAGO — A Guatemalan national who has been previously removed from the United States three times, and who is wanted by police in Champaign, Illinois, for allegedly causing a fatal crash while driving under the influence on New Year’s Day, was added Monday to U.S. Immigration and Customs Enforcement’s (ICE) Most Wanted list.

Esteban Juarez-Tomas, 33, is wanted for aggravated DUI, resulting in the death of LaDonna (Jeannie) Brady, of Mahomet, Illinois, on Jan. 1, 2017, according to police records. He is also wanted by ICE for removal from the United States, after resolution of the criminal case against him, and any subsequent jail term.

Juarez-Tomas, a laborer, has been known to use the following aliases: Salvador Diaz-Gomez, Victor Ochoa and Edgar Gomez-Estrada. He is 5’5” tall and weighs about 140 pounds with brown eyes and black hair.

Juarez-Tomas was ordered deported in absentia Jan. 13, 2003, following his February 2002 arrest by the now defunct Immigration and Naturalization Service (INS) near Springfield, Missouri. He was again arrested July 4, 2010, by the Warren County (Illinois) Sheriff’s Department and charged with aggravated battery. ICE lodged a detainer July 13, 2010, and he was taken into ICE custody at the completion of his sentence and removed to Guatemala Sept. 9, 2010.

On Oct. 31, 2011, Juarez-Tomas was apprehended by U.S. Border Patrol in Arizona and was subsequently removed again to Guatemala on Nov. 14, 2011. On Dec. 23, 2011, he was again apprehended by U.S. Border Patrol near Rio Grande City, Texas, and was removed a third time Jan. 18, 2012.

Despite attempts by ICE to locate him, Juarez-Tomas remains at large. He was last known to live in Champaign, and may have fled to Guatemala after the fatal crash.

MAHOMET, IL – LaDonna “Jeannie” Brady, 45, of Mahomet, died early Sunday, Jan. 1, 2017, at Carle Hospital after a fatal car accident on I-74 in Champaign, Ill.
Jeannie was born March 1, 1971, in Springfield, Ill.
She is survived by her parents, Jim and Francis Damm of Mason City; natural mother, Norma Benjamin of Oakford; three sisters: Deanna Damm of Greenview, Jennifer Crowl of Auburn, and Tracy Setzer, Sweetwater; her husband, Eric Brady of Mahomet; son, Joshua Evans of Rockford; stepdaughter, Kayla Brady of Mahomet; and many nieces, nephews, and cousins.
She married Eric Brady on Aug. 8, 2009, in Philo, Ill. She worked at the Christie Clinic business office leveraging her natural talent for helping people.

Jeannie made the most out of life and its simple pleasures: spending time with family and friends, riding her motorcycle and helping others achieve their dreams.

Richard Margolies didn’t call a taxi but instead took his party on the road

On June 18, 2017, at 5:29 pm, Officer Carletta responded to the parking lot of the Village Green Shopping Center for the report of a male sleeping in a vehicle. Officer Carletta located the vehicle, a 1998 Toyota, parked with the motor running, in the area of the Lighten Up Hair Salon.

Officer Carletta approached the vehicle and observed a male leaning on the steering wheel, asleep. Officer Carletta was able to rouse the male, who sat up and opened his window. The male was identified as Richard C. Margolies, 47, of Budd Lake, N. J.

As Officer Carletta spoke with Margolies, he noted that Margolies appeared to be impaired.

Margolies was asked to exit his vehicle to perform field sobriety tests. Margolies was subsequently placed under arrest and transported to police headquarters, where he submitted to chemical breath testing.  Margolies was charged with DWI, Reckless Driving, Failure to Exhibit Driver’s License, and Failure to Notify Change of Address. Margolies was released to a sober driver.

Mothers Against Drunk Driving in cooperation with the New Jersey Division of Highway Traffic Safety; hosted a statewide recognition ceremony on June 14, 2017. The annual ceremony, “Saving Lives by Preventing Crashes”, honors officers statewide for their proactive endeavors in enforcing the D.W.I. laws for the prior year. “Approximately 1/3 of all traffic fatalities are caused by impaired drivers and in those crashes, about ten thousand (10,000) people die annually. The Mount Olive Township Police arrested one hundred eleven (111) people in 2016 for impaired driving. The honored officers accounted for sixty-five (65) of those arrests. We are proud of our police department’s work to save lives and in particular the efforts of Officers Galop, Spotts, Elbaum, Reynolds, and Carletta. “

The White Way to Drive While DWI

On May 25, 2017, at 9:38 pm, Officer Carletta was on routine patrol when he observed a 2002 Ford make an improper left turn from Rt. 46 east onto Netcong Road. Officer Carletta initiated a motor vehicle stop of the Ford in the area of George’s Liquors. Officer Carletta made contact with the driver, who was identified as Nicholas L. White, 27, of Hamburg, N.Y. As Officer Carletta spoke to White he detected the odor of an alcoholic beverage, and White appeared to be impaired. White was asked to exit his vehicle to perform field sobriety testing.

White was subsequently placed under arrest and transported to police headquarters, where he submitted to chemical breath testing.

White was charged with DWI, Reckless Driving, Improper U-turn, Unlicensed Driver, and Cutting Across Private Property to Avoid a Traffic Signal. White was released to a sober driver pending a court hearing.

Delaware State Police Report Cody Hopkins Dead; Speed and Alcohol Factors in Crash

Milford- The Delaware State Police Collision Reconstruction Unit is currently investigating a fatal motor vehicle crash that has claimed the life of a Milford man which occurred early this week.

The investigation thus far has determined that the crash occurred on Sunday, June 18, 2017, at 11:24 p.m., as Cody S. Hopkins, 24, was operating a 2006 Dodge Ram and was traveling in a northbound direction on Canterbury Road just south of Blue Jay Lane. As Hopkins attempted to negotiate a curve in the roadway, his vehicle’s right side tires traveled off of the east edge of the roadway. The Ram then re-entered the roadway and began to rotate in a clockwise direction before skidding off of the roadway. It then traveled in a northeasterly direction before striking a group of trees and overturning, ejecting Hopkins onto Blue Jay Lane. The Dodge continued traveling in a northeasterly direction until it came to rest on its right-hand side on Blue Jay Lane.

Speed and alcohol use appear to be factors in this crash which remains under investigation at this time.

Cody Hopkins, who was not properly restrained at the time of the crash, was removed from the scene and transported to the Milford Memorial Hospital. He was later transported to the Christiana Hospital where he was admitted in critical condition before being declared dead on Tuesday, June 20, 2017. Speed and alcohol use appear to be factors in this crash which remains under investigation at this time.

Cody was born Dec. 22, 1992, in Milford, to Lori and William G. (Bill) Hopkins Jr. He graduated from Sussex Technical High School in 2011 with a focus on agriculture.
Cody was passionate about anything outdoors, including hunting, fishing,  and dirt track racing. He traveled around the East Coast racing at various dirt tracks as a teenager. Although he stepped away from full-time driving, he could be found at the track helping his buddies, and even made cameo appearances behind the wheel. He lived out one of his dreams when he landed his job working for Bonk Farms in Magnolia. He worked side by side with other farmers over 50 hours a week and was such a dedicated worker.
Cody is survived by his parents, Lori and William G. Hopkins Jr. of Harbeson; sisters Corey White (Matt) of Newark and Caitlin Hopkins (Mike Moore) of Georgetown; grandparents, Myrna Willoughby of Harbeson and Thelma and William G. Hopkins Sr. of Harbeson; aunts and uncles, including Sheri and George Sweeney, Robert Willoughby and Daniel Slagle, Wendy and John McVicker, and Connie and Michael Heck; and numerous loving cousins. He was preceded by his maternal grandfather, Robert J. Willoughby Sr.
Cody has given numerous recipients the gift of life through organ donation. He was able to donate several organs to people who will carry on his legacy.
Visitation will be held at Eagle’s Nest Fellowship, 26633 Zion Church Road, Milton, Monday, June 26, from 4 to 6 p.m., followed by a memorial service at 6 p.m. Casual attire requested. Light refreshments to follow.

Killed by her DUI boyfriend Adam McIlvee, Ashley Harvey’s family lists him as a ‘survivor’ in obituary

The man who killed Ashley Marie Harvey, the late woman’s boyfriend, Adam Scott McIlvee,  is scheduled to be sentenced to as little as 18 months in prison for DUI homicide following his guilty plea to DUI homicide.

Indeed, like all DUI killers who do not themselves perish in a crash, he is a survivor, and after a short stint in prison will soon be resuming his normal life while his victim is gone forever.

  • According to Police:
    McIlvee was westbound on West Philadelphia Avenue, which is Route 73 when he lost control at a bend and the vehicle struck a guide rail along the eastbound lane.
  • McIlvee and Harvey were thrown from the vehicle, and police initially were uncertain who was driving.McIlvee was taken by ambulance to Lehigh Valley Hospital with what police described at the time as serious injuries.
  • A crash reconstruction team from the Berks County district attorney’s forensic services unit assisted Colebrookdale police with the investigation, which determined McIlvee was the driver.

An Oley Township man admitted in court that he was driving drunk when his vehicle crashed in Colebrookdale Township last year, fatally injuring his girlfriend.

Adam S. McIlvee, 24, of the 100 block of Bertolet Mill Road pleaded guilty Tuesday before Judge Eleni Dimitriou Geishauser to homicide by vehicle, drunken driving and driving at an unsafe speed for conditions.
Ashley Harvey, 22, of Pennsburg, Montgomery County, was pronounced dead by a trauma doctor in Lehigh Valley Hospital near Allentown on Aug. 4 at 4:40 a.m., several hours after the crash. She was a passenger in McIlvee’s vehicle. MORE

Ashley Marie Harvey, 22, of Pennsburg, died suddenly on August 4, 2016. She was the beloved daughter of Dennis Harvey Sr and Michelle (Bivighouse) Harvey of Pennsburg. Ashley was a fun, free spirit who loved life with a strong love of nature and animals. She adored her cats: Ozzie, Zimba, and Enzo. A Valley Center couple celebrating their 64th wedding anniversary were killed just miles from their home by a suspected DUI driver.

Bobby, 83, and Alleta Jo Durant, 81, were killed when a suspected drunk driver crossed into their lane and slammed into their Mercedes head-on Tuesday afternoon, California Highway Patrol (CHP) officials said.

The couple was celebrating their 64th wedding anniversary just before they were killed in the fatal crash, about five miles away from their home on the 28000 block of Lilac Road.

Friends knew the pair as Bob and Jo, and their daughter says they were always side-by-side. They met in high school and married when Bob was 19 and Jo was 17.

Twenty years ago, Bob and Jo moved to California and started growing avocados together.

Their daughter says they were good, family-oriented people. She would regularly get together with her parents and brother, who all live nearby.

VALLEY CENTER (06/28/2017) – A 27-year-old Escondido woman is in custody Wednesday on suspicion of driving while high on drugs when she caused a head-on crash that killed an 83-year-old man and his 81-year-old passenger Tuesday in rural North County.

CHP says driver of Ford Explorer loaded with pool chemicals was DUI-drugs when she slammed into Mercedes and killed both the driver and passenger from Valley Center

The fatal collision occurred about 1:10 p.m. in the 28000 block of Lilac Road in Valley Center when the woman’s 2007 Ford Explorer Sport Trac crossed into oncoming traffic, California Highway Patrol Officer Chris Parent said. Witnesses told law enforcement the Explorer collided head-on with a Mercedes-Benz E300.

The names of the victims were not immediately available, but Parent said the Mercedes’ driver was an 83-year-old Valley Center man and his passenger was an 81-year-old Oceanside woman. Both were pronounced dead at the scene.

The driver of the Explorer was flown to Palomar Hospital with major injuries and arrested on suspicion of driving under the influence of drugs, Parent said. Her name was not immediately released.

“It is suspected DUI so we are looking at prosecution,” said Captain Amy Mangan with California Highway Patrol.

The speed in the area of the crash is 55 miles-per-hour, but some Valley Center residents want a lower speed limit.

“I heard they were going to be dropping the speed limit, but the problems are falling off,” said Patrick Matthews.

For other Valley Center residents, the problem is the two casinos in Valley Center.  MORE
